  • Yes, but only if there is a dispute as to the nature and length of the relationship. Reaching a consensus of the length of your relationship (if the relationship was de-facto or partially de-facto) then this limits the issues in dispute. We guide you through what documentation is needed.

  • If this is an issue in dispute, we help clarify parentage issues and advise on your obligations to the child, whether you are biological, adoptive, or intended parents.

  • Parental responsibility is conferred to parents by default under the Family Law Act. Where there is a dispute as to the parents or carers, we guide you and advise accordingly on your rights and obligations, whether you are seeking an order for parental responsibility or decision-making responsibility.   • If you have a Binding Financial Agreement (BFA) and need to enforce it, the first step is to seek urgent advice from an experienced family law specialist. Under the Family Law Act 1975, a financial agreement is legally binding if it meets strict statutory requirements, including independent legal advice for both parties.

    If the other party refuses to comply, you may apply to the Federal Circuit and Family Court of Australia for enforcement orders. The Court can compel compliance, impose penalties, or, in some cases, set aside the agreement if it is invalid or unenforceable.
